Paid Services Terms

These Paid Services Terms ("Paid Terms") apply to any purchase made through BoltBot⚡, including subscriptions, one-time purchases, and any other paid features. These Paid Terms supplement our Terms of Service and Privacy Policy. In the event of a conflict, these Paid Terms control with respect to paid services.

If you are under 18 years of age, you must have the permission of a parent or legal guardian to make any purchases through BoltBot⚡.

BoltBot⚡ operates as a Discord bot. You must have a valid Discord account in good standing to access and use our paid services. Your use of Discord is subject to Discord's Terms of Service and Community Guidelines.

BoltBot⚡ is not affiliated with, endorsed by, or sponsored by Discord Inc. If your Discord account is terminated or suspended for any reason, your access to paid services may be interrupted. We are not responsible for any loss of access resulting from Discord account termination, though we may offer prorated refunds at our sole discretion.

We use third-party payment processors to handle all transactions. By providing a payment method, you represent and warrant that:

• (i) You have the legal right to use the payment method provided;
• (ii) You will pay all charges at the prices in effect when incurred;
• (iii) All payment information you provide is accurate and complete;
• (iv) We may retain your payment information on file; and
• (v) You authorize us to charge your payment method for all fees and applicable taxes.

We may retain and share your payment information with financial institutions and payment processors as necessary to process transactions. If a pricing error occurs, we may cancel the affected order, notify you, and issue a full refund.

We accept various payment methods, which may vary by country or region. You can update your payment method in the billing section of your account settings. We are not responsible for any fees charged by your bank or financial institution.

If your primary payment method fails, you authorize us to charge any backup payment method on file. All payments are processed by Stripe subject to the Stripe Services Agreement and Stripe Privacy Policy. We may receive updated card information from your payment provider.

At our discretion, we may offer the option to pay by invoice. Invoices must be sent within 45 days of the billing period and are payable within 30 days of receipt. All invoices are denominated in USD.

BoltBot⚡ offers premium subscription plans that provide access to enhanced features including AI providers, increased usage limits, and more. Details about available plans and current pricing are available in your account settings.

Billing & Auto-Renewal

Subscriptions are automatically renewing. You will be charged at the then-current rate on the date of purchase or trial expiration and on each subsequent renewal date.

Usage Limits

Subscriptions may include limits on messages, tokens, API calls, or other usage metrics. Usage limits reset at the beginning of each billing cycle. Unused allowances do not roll over to the next period. If you exceed your usage limits, you may need to upgrade your plan or wait until the next billing cycle. We reserve the right to throttle or restrict access if usage significantly exceeds reasonable expectations.

Price Changes

We may change subscription fees at any time for future billing periods. We will provide at least 30 days' notice before any price increase takes effect. By continuing to use the service after the price change, you accept the new pricing. If you do not agree, you may cancel your subscription before the change takes effect.

Cancellation

You may cancel your subscription at any time through your account settings, bot commands, or by contacting support. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No refunds are provided for the remaining portion of a billing period after cancellation.

Experimental Features

We may from time to time offer beta or experimental features to subscribers. These features will be clearly labeled as experimental or beta. You should not rely on the availability of experimental features when making purchase decisions. We may modify, limit, or remove experimental features at any time without notice.

BoltBot⚡integrates with third-party AI providers including OpenAI, Google, xAI, Cloudflare Workers AI, and Deepgram to deliver its features. AI-generated content is provided "as is" without any guarantee of quality, accuracy, completeness, or availability. AI models may change, be updated, or be replaced at any time. Usage and rate limits imposed by AI providers apply.

You must comply with each provider's applicable usage policies:

• xAI Terms of Service
• Cloudflare Workers AI
• Deepgram Terms of Service

We may modify, replace, or discontinue AI providers at any time. If such a change has a material negative impact on paid features, we will provide reasonable notice and may offer prorated refunds at our discretion.

You may not use paid services to:

• (i) Generate, distribute, or store illegal content;
• (ii) Engage in or promote hate speech, harassment, bullying, or discrimination;
• (iii) Generate, solicit, or distribute child sexual abuse material (CSAM) or any sexual content involving minors;
• (iv) Create or distribute malware, phishing content, or spam;
• (v) Reverse engineer, decompile, or disassemble any part of the service;
• (vi) Abuse, overload, or interfere with the service or its infrastructure;
• (vii) Impersonate any person or entity, or misrepresent your affiliation;
• (viii) Violate Discord's Terms of Service or Community Guidelines;
• (ix) Violate any AI provider's usage policies.

Voucher codes and promotional offers must be used for their intended, lawful purpose. We may disable or revoke codes at any time. Promotional codes have no cash value and may have expiration dates.

Promotional subscriptions will automatically renew at the full, non-promotional price at the end of the promotional period. To avoid being charged the full price, cancel before the promotional period ends.

We may limit free trials to one per user. If you cancel during a trial period, you may lose eligibility for future trial offers.

Except as expressly stated in these Paid Terms, our Refund Policy, or as required by applicable law, all payments are non-refundable. No credits or refunds will be provided for partial billing periods or unused services.

We may cancel or suspend your access to paid services for non-payment. We may retry failed payments or charge backup payment methods on file. You remain responsible for any uncollected amounts.

We may suspend your access for non-payment without immediately canceling your subscription. We may also terminate your access for violating these Paid Terms, our Terms of Service, Discord's Terms of Service, or the Prohibited Uses section above. No refund will be provided for the unused portion of any prepaid subscription in the event of termination for cause.

PAID SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PAID SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY AI MODEL WILL REMAIN AVAILABLE. AI-GENERATED CONTENT MAY CONTAIN ERRORS, INACCURACIES, OR BIASES. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY INFORMATION OR OUTPUT GENERATED THROUGH OUR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF PAID SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless BoltBot, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

• (i) Your use or misuse of paid services;
• (ii) Your violation of these Paid Terms or any applicable law;
• (iii) Your violation of any third-party rights, including those of Discord and AI providers;
• (iv) Any content you submit through paid services; and
• (v) Your violation of the Prohibited Uses section.

You are responsible for all applicable taxes, duties, and levies associated with your purchases. You are also responsible for any data plan charges, internet access fees, or other charges from your service providers incurred while using BoltBot⚡.

We may change paid services without notice where changes are necessary, minor, or required by law. For changes that have a material negative impact on paid features, we will provide reasonable advance notice.

We reserve the right to discontinue any paid service entirely. If we discontinue a service for which you have a prepaid subscription, we will provide a prorated refund for the remaining unused portion of your subscription period.

These Paid Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Informal Resolution First

Before filing any formal dispute, please email support@boltbot.app and try to resolve it informally for at least 30 days. We take all concerns seriously and will work with you to find a resolution.

Binding Arbitration

If informal resolution fails, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English. The arbitrator's decision is final and binding.

Exceptions

Small claims court is available if you qualify. Either party may seek injunctive relief in court for intellectual property infringement. For disputes not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts located in Delaware. EU consumers retain statutory rights and may use the EU Online Dispute Resolution platform.

Statutory Warranties & Updates

If you are an EU consumer, we are obligated to ensure that paid services conform to their description and are of satisfactory quality. We will provide necessary updates to maintain conformity during the subscription period. Any commercial warranty offered by us is in addition to, and does not affect, your statutory consumer rights.

Right of Withdrawal

By consenting to immediate provision of paid services upon purchase, you acknowledge that you waive your right of withdrawal under the EU Consumer Rights Directive once the service has been fully provided or the digital content download has begun.

Severability: If any provision of these Paid Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary; all remaining provisions continue in full force.

Entire Agreement: These Paid Terms, together with our Terms of Service, Privacy Policy, and Refund Policy, constitute the entire agreement between you and BoltBot, LLC regarding paid services.

Electronic Communications: You consent to receive electronic communications from us regarding your purchases, billing, and account via email or Discord.

Assignment: You may not assign or transfer these Paid Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.

Force Majeure: We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control.

We may update these Paid Terms from time to time. For material changes, we will provide at least 30 days' notice via the service, website, Discord, or email. Your continued use of paid services after changes take effect constitutes acceptance of the updated terms.
